These Terms of Service (“Terms”) govern your access to and use of AI Tattoo: Ink Tattoo Design (the “App”) and our website located at https://www.tattooscope.com/.

The App is operated by Bloom Data Technology Limited (“we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About the App

AI Tattoo: Ink Tattoo Design is an AI-powered tattoo design app that allows users to generate tattoo ideas, browse tattoo templates, preview tattoo designs using camera or AR-style features, save favorites, view generation history, and share generated tattoo designs.

The App is designed for creative inspiration and entertainment purposes only. It does not provide professional tattoo, medical, dermatological, legal, cultural, or artistic advice.

2. Eligibility

You must be at least 13 years old, or the minimum legal age required in your country or region, to use the App.

If you are under the age of majority in your jurisdiction, you may use the App only with the consent and supervision of a parent or legal guardian.

By using the App, you represent that you meet these eligibility requirements.

3. Guest Use

The App currently supports guest usage and does not require account registration.

Because the App may store certain favorites, history, generated results, or local settings on your device, deleting the App, clearing device storage, changing devices, or reinstalling the App may cause local data to be lost.

We are not responsible for any loss of local data, favorites, history, generated images, or saved results.

4. AI Tattoo Generation

The App allows you to generate tattoo designs using text prompts, style selections, templates, or other creative instructions.

You understand and agree that:

• AI-generated designs may be inaccurate, unexpected, incomplete, or unsuitable for real-world tattoo use.
• Similar or identical results may be generated for other users.
• We do not guarantee that any AI-generated design is unique, original, copyright-free, trademark-free, culturally appropriate, or safe to tattoo permanently.
• You are responsible for reviewing generated designs before using them.
• You should consult a professional tattoo artist before getting any permanent tattoo.

The App is a creative tool, not a replacement for professional tattoo consultation.

5. Tattoo Preview and AR-Style Features

The App may provide camera-based or AR-style tattoo preview features.

These features are intended only to help you visualize possible tattoo placement or design style. They do not guarantee the real appearance, size, color, healing result, skin compatibility, or long-term look of any actual tattoo.

You understand that real tattoos may vary depending on many factors, including:

• Tattoo artist skill
• Ink quality
• Skin tone
• Skin condition
• Placement
• Body shape
• Lighting
• Healing process
• Aftercare
• Design complexity
• Tattoo size and detail level

You are solely responsible for any real-world tattoo decision you make based on the App.

6. User Content

“User Content” means any text prompts, descriptions, creative instructions, images, feedback, or other content you provide through the App.

You are responsible for your User Content.

By using the App, you represent and warrant that:

• You have the right to submit your User Content.
• Your User Content does not violate any law or third-party rights.
• Your User Content does not contain prohibited content described in these Terms.
• Your User Content does not infringe copyrights, trademarks, privacy rights, publicity rights, or other rights of any person or entity.

You retain any rights you may have in your User Content.

However, by submitting User Content to the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to process, transmit, display, reproduce, and use your User Content only as necessary to operate, provide, improve, secure, and support the App.

7. Generated Content

“Generated Content” means tattoo designs, images, previews, suggestions, or other outputs generated by the App.

Subject to your compliance with these Terms, you may use Generated Content for personal and non-commercial purposes.

You are responsible for determining whether Generated Content is suitable for your intended use.

We do not guarantee that Generated Content:

• Is unique
• Is original
• Does not resemble existing artwork
• Does not infringe third-party rights
• Is suitable for commercial use
• Is culturally appropriate
• Is safe or appropriate for permanent tattooing

Before using Generated Content for commercial purposes, merchandise, branding, client work, or permanent tattooing, you should conduct your own review and seek professional advice where appropriate.

8. Prohibited Content

You may not use the App to create, upload, request, generate, share, or promote content that includes or encourages:

• Pornographic, sexually explicit, or nude content
• Sexual content involving minors or any exploitative content
• Hate speech, harassment, threats, or abuse
• Content targeting people based on race, ethnicity, religion, nationality, disability, gender, sexual orientation, or other protected characteristics
• Violence, graphic harm, self-harm, or dangerous activities
• Terrorist, extremist, or criminal organization symbols or promotion
• Illegal activities
• Copyright, trademark, or intellectual property infringement
• Impersonation of another person or brand
• Private or sensitive personal information of others
• Medical misinformation or unsafe body modification advice
• Content that violates Apple App Store, Google Play, or applicable platform rules

We may block, remove, limit, or refuse to generate content that we believe violates these Terms or applicable laws.

9. Acceptable Use

You agree not to:

• Use the App for illegal, harmful, abusive, or fraudulent purposes
• Reverse engineer, copy, modify, or attempt to extract source code from the App
• Bypass subscriptions, payment systems, ads, access controls, or security features
• Use automated scripts, bots, scrapers, or other automated tools without permission
• Interfere with the operation of the App or our servers
• Abuse AI generation features
• Attempt to generate prohibited content
• Misrepresent generated designs as officially endorsed by us or any third party
• Use the App in a way that violates applicable laws or regulations

We reserve the right to suspend, restrict, or terminate access to the App if we believe you violated these Terms.

10. Subscriptions and Paid Features

The App may offer paid subscriptions, including weekly and yearly subscription options.

A subscription may unlock premium features such as:

• AI tattoo generation
• Higher generation limits
• High-quality outputs
• AR-style tattoo preview
• Saving generated results
• Premium templates or design features
• Other paid features shown in the App

Available features may vary by platform, country, app version, subscription plan, or promotional offer.

11. Billing

Subscriptions and in-app purchases are processed by Apple App Store or Google Play, depending on your device and where you made the purchase.

By purchasing a subscription, you agree to the billing terms provided by Apple or Google at the time of purchase.

We do not directly collect or store your full payment card information.

12. Auto-Renewal

Subscriptions may automatically renew unless canceled before the renewal date according to Apple App Store or Google Play rules.

Your account may be charged for renewal within the period specified by the applicable app store before the end of the current subscription period.

You are responsible for managing and canceling your subscription through the platform where you purchased it.

13. Cancellation

You may cancel your subscription through your Apple App Store or Google Play account settings.

Deleting the App does not automatically cancel your subscription.

After cancellation, you may continue to access paid features until the end of your current paid subscription period, unless otherwise stated by the applicable app store.

14. Refunds

Refunds are handled by Apple App Store or Google Play according to their own refund policies.

We do not control app store refund decisions.

To request a refund, you must contact the platform where you made the purchase.

15. No Free Trial

The App currently does not offer a free trial unless clearly displayed in the App or on the applicable app store purchase screen.

If a free trial, promotional offer, introductory price, or discount is offered in the future, the specific terms will be shown before purchase.

16. Rewarded Video Ads

The App may offer rewarded video ads.

Rewarded ads may allow you to unlock limited features, receive limited usage opportunities, or access certain content without a subscription.

You understand that:

• Rewards may vary by region, platform, app version, or ad availability.
• Ads may not always be available.
• Watching an ad does not guarantee access to all premium features.
• We may change, limit, or remove rewarded ad features at any time.
• Ad networks may process certain device, usage, and ad interaction data according to their own policies.

17. App Store and Google Play Terms

When you download or purchase the App through Apple App Store or Google Play, you may also be subject to Apple’s or Google’s own terms, policies, and billing rules.

If there is a conflict between these Terms and the applicable app store terms regarding payment, billing, cancellation, or refunds, the app store terms may control.

18. Intellectual Property

The App, including its software, interface, design, templates, layout, features, branding, logos, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, sell, rent, sublicense, or create derivative works from the App or its content unless we give you written permission.

Using the App does not give you ownership of the App, our technology, our brand, or our intellectual property.

19. Templates and Built-In Content

The App may provide tattoo templates, design styles, inspiration galleries, sample prompts, preview assets, or other built-in content.

These materials are provided for inspiration and personal use within the App.

You may not copy, resell, redistribute, or use our built-in templates or assets as a competing product or service.

20. Third-Party Services

The App may use third-party services for analytics, crash reporting, attribution, ads, billing, subscription management, AI generation, and other functions.

These third-party services may include, but are not limited to:

• Firebase Analytics
• Firebase Crashlytics
• AppsFlyer
• Google AdMob
• Apple App Store
• Google Play Billing
• RevenueCat or similar subscription management services, if integrated
• AI service providers

Your use of the App may also be subject to the terms and privacy policies of these third-party services.

We are not responsible for third-party services, websites, SDKs, ads, or content that we do not control.

21. Privacy

Your use of the App is also governed by our Privacy Policy.

22. Updates and Changes to the App

• Supported platforms
• User interface
• Availability of free or paid content

We are not liable for any modification, suspension, or discontinuation of the App or any feature.

23. Disclaimers

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy
• Availability
• Reliability
• Security
• Error-free operation

We do not guarantee that:

• The App will always be available
• The App will be error-free
• AI-generated designs will meet your expectations
• Tattoo previews will be accurate
• Generated designs will be unique
• Generated designs will be legally safe for commercial use
• Generated designs will be suitable for real tattooing
• Any issue or bug will be fixed immediately

24. Real Tattoo Disclaimer

Tattoo designs generated or previewed in the App are for creative reference only.

We do not provide professional tattoo advice, medical advice, dermatology advice, or body modification advice.

Before getting a real tattoo, you should consult a qualified professional tattoo artist and consider:

• Skin health
• Allergies
• Infection risks
• Pain tolerance
• Placement
• Size
• Long-term appearance
• Cultural meaning
• Professional or workplace restrictions
• Local laws and age requirements

You are solely responsible for any real tattoo decision you make.

We are not responsible for any dissatisfaction, injury, infection, allergic reaction, regret, cost, dispute, or other consequence related to a real tattoo.

25. Limitation of Liability

To the maximum extent permitted by law, Bloom Data Technology Limited and its officers, directors, employees, contractors, partners, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, personal injury, or other damages arising from or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim related to the App or these Terms will not exceed the amount you paid to us through the App in the three months before the claim arose, or USD $50, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

26. Indemnification

You agree to defend, indemnify, and hold harmless Bloom Data Technology Limited and its officers, directors, employees, contractors, partners, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use of the App
• Your User Content
• Your Generated Content
• Your violation of these Terms
• Your violation of applicable laws
• Your infringement of third-party rights
• Your real-world use of any tattoo design generated or previewed in the App

27. Termination

We may suspend, restrict, or terminate your access to the App at any time if we believe that:

• You violated these Terms
• You used the App unlawfully
• You attempted to bypass payment or access controls
• You abused AI generation features
• You created or attempted to create prohibited content
• Your use may cause harm to us, other users, third parties, or the App

You may stop using the App at any time.

Termination does not automatically cancel your subscription. You must cancel subscriptions through Apple App Store or Google Play.

28. Governing Law

These Terms are governed by the laws of Hong Kong, without regard to conflict of law principles.

Where local consumer protection laws require a different governing law or venue, those laws may apply.

30. Changes to These Terms

Your continued use of the App after the updated Terms become effective means you accept the updated Terms.
